About Landmark
Landmark Trust (Bermuda) Limited was formed in 1999 and is licensed by the Bermuda Monetrary Authority under the Trusts (Regulation of Business) Act 2001 to provide trust and related services.
Bermuda’s geographic location, its political and economic stability, its well developed infrastructure and the high standards of its judiciary provide the ideal setting for the establishment of trusts. Located in the Western Atlantic, Bermuda enjoys easy access from both the Americas and Europe by air and sea and thus affords it the status of being one of the world’s top tourist destinations as well as a centre for financial planning. Having been a centre for international business for many years, Bermuda boasts a sophisticated infrastructure comprising a wealth of law firms, accountants, investment managers, fund managers, insurance managers and other professional advisors.
Britain’s oldest self-governing colony, Bermuda’s elected Legislature draws on the assistance of many of the Island’s financial experts. Government regulations have therefore been purposefully designed to assist the industry and afford maximum security, whilst retaining flexibility for the client.
Based on English equity principles, Bermuda’s trust legislation is constantly reviewed and updated in order to offer the international advisor and their clients the very best possible situs in which to domicile their trust structures. Bermuda is one of the few jurisdictions whose law provides for the establishment of Purpose Trusts. These are trusts which do not require beneficiaries to be named and which therefore facilitate specific or quasiphilanthropic purposes of a confidential nature. Their uses are varied and include aircraft and shipping financing, owning private trust companies and the protection of assets. Bermuda’s legislation also protects trusts against foreign forced heirship and community property issues and provides for the implementation of asset protection planning.
The uses for trusts are extremely varied but include the following;
• Long term planning for a family’s financial future.
• Long term asset management.
• Protection of assets when changing domicile.
• Protection of assets from attack from future creditors.
• Protection of assets from exchange control or other forms of export restrictions.
• Providing for orderly administration and devolution of assets.
• Charitable objects.
• Purpose Trusts.
• To provide central control of multi-jurisdictional assets.
• To gain access to investments otherwise denied the client.
